Strawberry Notes Terms of Use

These Terms of Use ("Terms") are an agreement between you and Strawberry Notes LLC ("we", "us") about your use of the Strawberry Notes app and its related services (together, "Strawberry Notes"). By downloading or using Strawberry Notes, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Strawberry Notes.

1. What Strawberry Notes is

Strawberry Notes is an app for handwritten and typed notes, PDF annotation, flashcards and studying. Parts of it are optional online services:

• an AI assistant
• AI credits
• publishing to and downloading from a community library

2. Who can use it

• Minimum age. You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher.
• Under 18. If you are under 18, you need the permission of a parent or guardian, who agrees to these Terms for you.
• Your country. You may not use Strawberry Notes if the law of your country prohibits it.

3. Your notes and your content

• You own what you create. Your notes, drawings, flashcards and everything else you create or import in Strawberry Notes belong to you. We claim no ownership of them.
• Your notes stay with you. They are stored on your device and, if you turn on iCloud sync, in your own iCloud account. We do not have access to them.
• Keep your own backups. Because we do not hold your notes, we cannot recover them for you. Use iCloud sync and the full-library backup (Settings > Backup > Export All Notes) to protect them.
• What you import is your responsibility. You are responsible for the materials you import, such as PDFs, images, web clippings and videos, and for having the right to use them.

4. Subscriptions and purchases

• What you pay for. Using Strawberry Notes requires either an auto-renewing subscription (monthly or yearly) or a one-time Lifetime purchase. Current prices are shown in the app before you buy.
• Free trial. The yearly plan may include a free trial for eligible new subscribers. If you do not cancel before the trial ends, the subscription starts and you are charged.
• Payment and renewal.
  • Payment is charged to your Apple Account when you confirm the purchase, or when a trial ends.
  • A subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends.
  • You can manage or cancel it in your Apple Account settings (Settings > [your name] > Subscriptions).
  • Cancelling stops future renewals. You keep access until the end of the period you paid for.
• Lifetime. Buying Lifetime does not cancel an existing subscription or trial. Cancel those in your Apple Account settings.
• Refunds. All purchases are processed by Apple, and refunds are handled by Apple under its policies. We cannot issue refunds for App Store purchases ourselves.
• Price changes. We may change prices. Apple will notify you of subscription price changes as its rules require.

5. The AI assistant and AI credits

• Included in every plan. The AI assistant is included in every plan. It uses AI credits, which pay for the cost of running AI models.
• Getting started.
  • Sign in with Apple or Google to receive a one-time starter allowance of credits.
  • You can buy more credits as in-app purchases.
  • You can also use your own OpenRouter API key instead of credits. Those requests are then billed to your OpenRouter account under OpenRouter's terms.
• What credits are and how they're used.
  • Credits are a prepaid balance for AI usage only. They never expire.
  • Each request uses credits according to the model you choose and the amount of work it does, at the prices shown in the app.
  • We may change model prices or the models offered. Changes apply only to future requests.
  • Credits are tied to your account and cannot be transferred, sold or exchanged for cash.
  • The starter allowance has no cash value. We may change or end it for new accounts.
• Deleting your account forfeits your balance. Unused credits, including purchased credits, are forfeited when you delete your account. The app warns you before you confirm. Refunds of credit purchases are handled by Apple.
• Deleting an account does not reset it. If an account that used the AI assistant is deleted while it owes credits, that unpaid balance stays attached to a scrambled key of its Apple or Google sign-in, as described in the Privacy Policy. It moves to any new account created with the same sign-in. A new account created with a sign-in that already used the AI assistant does not receive another starter allowance.
• Your permission and your data.
  • The AI assistant sends your question and parts of your notes to third-party AI providers. It does this only after you allow it, and you can withdraw permission in Settings.
  • The Privacy Policy explains what is sent and to whom.
  • Do not include sensitive personal information about other people in AI requests.
• AI can be wrong.
  • AI output is generated automatically and can be inaccurate, incomplete or out of date. Check important information against reliable sources.
  • AI output is not professional advice (for example medical, legal or financial advice).
• Academic honesty. You are responsible for following your school's rules on using AI in coursework and exams.
• Rules from AI providers. You must also follow the usage rules of the AI providers. For example, do not use the assistant to create unlawful, harmful or deceptive content. We may limit or suspend AI access if it is abused.
• Rights in AI output. As between you and us, you may use the AI output you receive. We make no promise that it is unique or free of third-party rights.

6. Your account

• What an account is for. An account (Sign in with Apple or Google) is optional. It is needed only for AI credits and for publishing, blocking and some reporting.

• Your responsibility. You are responsible for activity under your account and for keeping your Apple or Google sign-in secure.

• Deleting it. You can delete your account at any time in Settings > Account > Delete Account. This deletes:

  • your account
  • your AI balance and usage records
  • everything you published
  • the reports and blocks you made

  Your notes on your devices and in your iCloud are not affected.

7. The community library (publishing)

• Publishing. You can publish notes, templates and flashcard decks to the Strawberry Notes community library. When you publish, you agree to the publishing agreement shown in the app, and you promise that:
  • you created the content, or you hold every right needed to share it publicly, including for every PDF, scan, image, font and text embedded in it and in any subnotes published with it
  • it does not infringe anyone's copyright, trademark, privacy or other rights, and contains no material you may not distribute, such as pages from commercial textbooks, paid course materials or exams
  • it contains no personal information about other people without their permission, and nothing unlawful, hateful, sexually explicit, harassing or harmful to minors
• The licence you give.
  • You keep ownership of what you publish.
  • You give us a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, distribute and technically adapt it (for example thumbnails, format conversion and search indexing), in order to operate and promote the library.
  • You give other users a licence to download your content and to use and modify their copy for personal and educational use.
  • Our licence ends when you withdraw the content, except for copies users have already downloaded and for backups kept for a limited time.
• Review and removal.
  • Every submission is screened automatically and reviewed by a person before it is listed.
  • We may refuse or remove any content at any time.
  • We do not promise that content will be listed or stay listed.
• Reporting. You can report content and block authors in the app. Rights holders can send copyright notices to [email protected].
  • We remove content that is the subject of a valid notice and tell the publisher, who may send a counter-notice.
  • Accounts that receive repeated valid notices lose the ability to publish.
• Using other people's content. Content in the library is provided by other users, not by us. We do not guarantee its accuracy. Use it for personal and educational purposes only, and respect its author's rights.
• Your responsibility. You are responsible for what you publish. To the extent the law allows, you will cover the reasonable costs of third-party claims against us caused by content you published in breach of this section.

8. Acceptable use

Do not:

• use Strawberry Notes to break the law or infringe anyone's rights
• upload or publish malware, or content described in section 7 as not allowed
• try to access other users' data, our servers or AI services without permission; interfere with or overload them; or bypass limits, credit charges or security measures
• reverse engineer, resell or redistribute the app except as the law expressly allows
• abuse the reporting system or harass other users

We may suspend or end your access to online services (the AI assistant, credits purchased afterwards, and publishing) if you break these Terms, after notice where reasonable.

9. Third-party services and content

Strawberry Notes works with services run by others, and they have their own terms and privacy policies:

• Apple (App Store, iCloud, Sign in with Apple)
• Google (Sign-In, handwriting models, YouTube)
• OpenRouter and AI model providers
• web pages you open in the built-in browser

We are not responsible for third-party services or content. Other companies' names and trademarks mentioned in the app belong to their owners and do not imply endorsement.

10. Our rights

• Our property. Strawberry Notes, including its software, design, name and logos, belongs to us and our licensors and is protected by law. "Strawberry Notes" is our trademark.
• Your licence to use the app. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, under these Terms and Apple's Usage Rules.
• Feedback. If you send feedback, we may use it without owing you anything.

11. Changes and availability

• Features can change. We may change, add or remove features, and we may stop offering online services.
• Advance notice. If we plan to discontinue the app, we will try to give reasonable notice. You can always export your library.
• Changes to these Terms. We may update these Terms. If a change is significant, we will tell you in the app before it takes effect. If you keep using Strawberry Notes after that, you accept the updated Terms.

12. Disclaimers and limitation of liability

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived. Subject to that:

• No warranty. Strawberry Notes is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free. We do not promise that handwriting recognition, search or AI output will be accurate, or that data will never be lost.
• Excluded losses. To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or grades.
• Cap on liability. To the fullest extent the law allows, our total liability for any claim relating to Strawberry Notes is limited to the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater.

13. Ending these Terms

You can stop using Strawberry Notes at any time and delete your account in the app. Sections 3, 5 (on forfeiture and AI output), 7 (licences already granted and your responsibility), 10, 12 and 15 continue after these Terms end.

14. Privacy

Our Privacy Policy explains how we handle personal information.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Disputes will be resolved in courts with jurisdiction in California, unless the law of your country gives you the right to bring proceedings where you live.

16. Apple App Store license

If you download Strawberry Notes from Apple's App Store, Apple's standard end-user license agreement applies to the app.
